Do You Know Florida's 14- Day Rule?

Have you had a recent traffic accident? Did you know the clock began ticking the moment the accident happened? People come to us all the time weeks and months after an accident and because they did not know about Florida’s 14-day rule, they end up having  to pay the bill themselves. Kinexis Chiropractic has been getting people the treatment they deserve and getting them better since 2014. If you are in any kind of an accident, protect yourself and make an immediate appointment to see Dr. Adamson and his team.

Florida’s 14-Day Rule

In the state of Florida, if you have been involved in a car accident, the law states that you must receive initial medical services and care within 14 days to qualify for personal injury protection benefits. (PIP)  If you do not seek this care, legally, insurance companies have the right to deny any claims you make regarding the accident in the future. They have the right to refuse payment for medical bills that would otherwise be covered by your personal injury protection plan in Florida.

Florida Statute 626.736 outlines the stipulations of this law.

What Is Florida's Personal Injury Law?

Personal injury is a legal term for an injury to the body, mind or emotions, as opposed to an injury to property. In common-law jurisdictions, the term is most commonly used to refer to a type of tort lawsuit in which the person bringing the suit (the “claimant” in English Law or “plaintiff” in American jurisdictions) has suffered harm to his or her body or mind. Personal injury lawsuits are filed against the person or entity that caused the harm through negligence, gross negligence, reckless conduct, or intentional misconduct, and in some cases on the basis of strict liability.

Different jurisdictions describe the damages (or, the things for which the injured person may be compensated) in different ways, but damages typically include the injured person’s medical bills, pain and suffering, and diminished quality of life.

What is Personal Injury Protection Insurance In Florida (PIP)?

PIP, which stands for “personal injury protection,” is insurance that pays you for personal injuries that you suffer in a car crash. When you have PIP insurance, it pays you for your injuries even if you are proven to be at fault for the accident. In the state of Florida, the law requires that all motorists have PIP insurance to drive.

Florida requires every person who registers a vehicle in the state to have PIP coverage that pays at least $10,000 for qualifying injuries and damages to any person hurt in a vehicle crash, regardless of who’s at fault. State law requires a person to have this insurance before they can receive a valid registration for a vehicle. It covers medical bills from emergency services, hospitals, diagnostic studies, a percentage of your lost wages and more.

What Should I do if I have been in a car accident?

Average healthcare providers may be making five critical mistakes that can damage your recovery and your ability to recoup your losses.

Undiagnosed/Underdiagnosed spinal ligament injuries.

You now know the importance of working with a competent and thorough healthcare provider that knows how to find these hidden spinal ligament injuries and how to have them documented to protect you so you can get the appropriate compensation that you deserve.

Failure to document permanent injury.

The provider must know how to properly do this and have the systems in place to document permanent injury with verifiable findings. This is crucial so that you can get the care and benefits that you need.

Not documenting what you can no longer do.

This refers to what are called Loss of Enjoyment factors, or LOE. Your provider failing to do this will absolutely hurt the success of your case.

Not clearly documenting the difficulty you have with various activities.

These are referred to as Duties under Duress, DUD. These are relevant to permanent injuries and crucial for the case.

Not documenting future care needs in a highly objective fashion.

Failing to do so does a huge disservice to you as you may have an injury that warrants an established level of permanency. These patients oftentimes deserve a settlement that includes future care to assist them long after the injury case is closed. In order for future care to be relevant, the patient has to have his injuries fully diagnosed and documented.
