Florida’s 14-Day Rule

In the state of Florida, if you have been involved in a car accident, the law states that you must receive initial medical services and care within 14 days to qualify for personal injury protection benefits. (PIP)  If you do not seek this care, legally, insurance companies have the right to deny any claims you make regarding the accident in the future. They have the right to refuse payment for medical bills that would otherwise be covered by your personal injury protection plan in Florida.

Florida Statute 626.736 outlines the stipulations of this law.

What Is Florida's Personal Injury Law?

What is Personal Injury Protection Insurance In Florida (PIP)?

PIP, which stands for “personal injury protection,” is insurance that pays you for personal injuries that you suffer in a car crash. In the state of Florida, the law requires that all motorists have PIP insurance to drive.

Florida requires every person who registers a vehicle in the state to have PIP coverage that pays at least $10,000 for qualifying injuries and damages to any person hurt in a vehicle crash, regardless of who’s at fault. State law requires a person to have this insurance before they can receive a valid registration for a vehicle. It covers medical bills from emergency services, hospitals, diagnostic studies, a percentage of your lost wages and more.
